Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and EyAy Apps ("we", "us") governing your use of the NailSense mobile application (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the App.

3. Subscriptions and payments

The App may offer auto-renewing subscriptions and other in-app purchases billed through your Apple account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the period. You can manage or cancel subscriptions in your App Store account settings. Any unused portion of a free trial is forfeited when you purchase a subscription. Prices and offerings may change; applicable changes will be presented before they take effect.

4. Your content

You retain ownership of the photos and content you submit ("User Content"). You grant us a limited license to host, process, and transmit your User Content solely to operate and provide the App's features to you. You represent that you have the rights to the content you submit and that it does not infringe others' rights or violate any law.

5. Acceptable use

You agree not to: submit content that is unlawful, infringing, or that depicts other people without their consent; use the App to harass, harm, or violate the rights of others; attempt to reverse engineer, decompile, or interfere with the App or its security; or use the App in violation of applicable law.

6. AI-generated results

NailSense provides AI-generated suggestions for entertainment and informational purposes only and does NOT provide medical or health advice. Always consult a qualified healthcare professional about any health concern.

The App relies on artificial-intelligence models. Outputs may be inaccurate, incomplete, or unexpected, and are provided without warranty of correctness or fitness for any particular purpose. You are responsible for how you use any results.

7. Intellectual property

The App, including its software, design, and branding, is owned by us and our licensors and is protected by intellectual-property laws. Except for the license granted above, we reserve all rights.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the twelve months before the claim.

10. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or to protect the App and its users. Sections that by their nature should survive termination will survive.

11. Apple

These Terms are between you and EyAy Apps, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply. (Update this section if your developer entity is established elsewhere.)

13. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, where appropriate, provide notice. Continued use of the App after changes take effect constitutes acceptance.
